Kawaskimhon Aboriginal Moot 2026 In-Person

Windsor Law is proud and honoured to host the 2026 Kawaskimhon Aboriginal Moot!

ABOUT THE MOOT

The Native Law Students Association of the University of Toronto held the first Kawaskimhon Moot in 1994. Each year, a different university hosts the moot and welcomes law students from nearly every law faculty across Canada. It is a unique opportunity for students to learn from Indigenous Legal customs of negotiation, dispute resolution, and consensus-building.

The Kawaskimhon Moot is a consensus-based, non-adversarial moot that incorporates Indigenous legal traditions alongside federal, provincial and international law, and concepts of dispute resolution. Teams may represent a variety of parties (depending on the nature of the moot problem) such as First Nations, Band Councils, traditional Chiefs’ organizations, government agencies, and industry.

Mooters participate in roundtable negotiations on a particular topic in Indigenous law, representing their assigned party’s positions to their circles. Facilitators guide the discussions with the goal of reaching a consensus. There are no competitive awards. Instead, the Kawaskimhon Moot allows students to deepen their understanding of Indigenous legal issues and Aboriginal law.

AGENDA

Day 1 - On the first day, participants present oral arguments based on written submitted factums or other legal documents. At the end of the first day, the host law school prepares a cultural night, which usually includes a banquet, singers, and dancers.

Day 2 - Kawaskimhon participants are required to work toward reaching a consensus on the mooted problems or issues by the end of the second day. Previous moots have addressed band membership rights, territorial overlaps, the effects of hydro projects on Indigenous lands and territories, Métis rights and Aboriginal heritage.
